Terms of Use

These terms describe how Mentiaq's services may be used, both by restaurants that install Mentiaq and by guests who pay through it. By using the service you agree to them.
1. What Mentiaq does
Mentiaq lets restaurant guests view, split and pay their bill by scanning a QR code at their table. Payments are processed by Stripe, our regulated payment provider. Mentiaq is not a bank and does not hold guest funds.
2. For guests
Paying through Mentiaq is optional and free for guests: you pay exactly the bill amount plus any tip you choose. Tips go to the restaurant team in full. Once a payment is confirmed you receive an on-screen confirmation and, if you request it, a receipt by email.
If something about your bill looks wrong, speak to the restaurant staff first: the restaurant remains responsible for what is on the bill, its prices and its service.
3. For restaurants
Restaurants use Mentiaq under the plan they have selected. Fees are charged per transaction and, where applicable, per month, as described on our pricing page. There is no lock-in: you can cancel your plan at any time with effect from the end of the current billing period.
Restaurants must provide accurate information during onboarding, comply with Stripe's terms for connected accounts, and only use Mentiaq for legitimate hospitality sales.
4. Refunds and disputes
Refunds are issued by the restaurant through its Mentiaq dashboard and returned to the guest's original payment method. Card disputes (chargebacks) follow the card network's rules and are handled through Stripe.
5. Acceptable use
You may not use Mentiaq to break the law, to process payments unrelated to the restaurant's business, or to interfere with the service's security or availability. We may suspend accounts that do.
6. Liability
Mentiaq provides the service with reasonable skill and care but cannot guarantee uninterrupted availability. To the extent permitted by law, our liability is limited to the fees the restaurant paid to Mentiaq in the three months before the event giving rise to a claim. Nothing in these terms limits liability that cannot legally be limited.
7. Changes and governing law
We may update these terms as the product evolves; meaningful changes will be announced to restaurants in advance. These terms are governed by Spanish law, and disputes are subject to the courts of Madrid, Spain.
